1. INTRODUCTORY PROVISIONS

1.1. These terms and conditions govern the mutual rights and obligations between the seller and a natural person – consumer (hereinafter referred to as the “buyer”) when concluding a purchase contract via the online store on the website www.nox-equipment.com.

1.2. These terms and conditions apply only to consumers. Entrepreneurs are subject to the regime under the Civil Code, unless stated otherwise.

1.3. Provisions deviating from these terms and conditions may be agreed individually in the purchase contract.

1.4. The purchase contract and the terms and conditions are concluded in the Czech language.

1.5. The seller reserves the right to amend the terms and conditions. The version valid at the time of conclusion applies to already concluded contracts.


2. USER ACCOUNT

2.1. The buyer may order goods with or without registration.

2.2. The buyer is obliged to provide true and up-to-date information.

2.3. Access to the account is secured by a password. The buyer is obliged to protect their login details.

2.4. The seller may cancel the account in case of breach of conditions or long-term inactivity.


3. CONCLUSION OF THE PURCHASE CONTRACT

3.1. All presentation of goods is informative and does not constitute an offer to conclude a contract.

3.2. The buyer places an order via the order form.

3.3. Before submitting the order, the buyer has the opportunity to check and modify the entered data.

3.4. By submitting the order, the buyer confirms that they have read the terms and conditions.

3.5. The contract is concluded upon confirmation of the order by the seller.

3.6. The seller reserves the right to refuse an order (e.g. unavailability of goods, obvious pricing error).


4. PRICE AND PAYMENT TERMS

4.1. Prices are stated including VAT and all fees.

4.2. The buyer may pay:

by bank transfer

by online card

cash on delivery

4.3. Shipping costs are stated during the order process.

4.4. The tax document is sent electronically.


5. DELIVERY OF GOODS

5.1. Goods are delivered to the address specified by the buyer.

5.2. The buyer is obliged to accept the goods.

5.3. Upon receipt, the buyer is obliged to check the shipment.

5.4. If the buyer does not accept the shipment without reason, the seller may claim compensation for costs.


6. WITHDRAWAL FROM THE CONTRACT

6.1. The buyer has the right to withdraw from the contract within 14 days from receipt of the goods.

6.2. Withdrawal may be sent by e-mail or via a form.

6.3. The buyer returns the goods within 14 days from withdrawal.

6.4. The buyer bears the costs of returning the goods.

6.5. The seller refunds the money within 14 days from withdrawal, but not before receiving the goods.

6.6. The buyer is responsible for any decrease in the value of the goods due to improper handling.

6.7. Withdrawal from the contract is not possible in the case of:

goods modified to order

sealed hygienic goods after unsealing

perishable goods


7. RIGHTS FROM DEFECTIVE PERFORMANCE (COMPLAINTS)

7.1. The seller is responsible for ensuring that the goods are free of defects upon receipt.

7.2. If a defect appears within 12 months of receipt, it is presumed to have existed at the time of receipt.

7.3. The buyer may file a complaint within 24 months of receipt.

7.4. In the event of a defect, the buyer has the right to:

repair

replacement

7.5. If repair or replacement is not possible, the buyer has the right to:

a reasonable discount

withdrawal from the contract

7.6. Complaints can be made by e-mail or in person.

7.7. The complaint will be resolved within 30 days.


8. REVIEWS

8.1. Reviews on the e-shop come from customers who have made a purchase.

8.2. Rating is possible only after placing an order.


9. OUT-OF-COURT DISPUTE RESOLUTION

9.1. The competent authority is the Czech Trade Inspection Authority (www.coi.cz).

10. PERSONAL DATA PROTECTION

10.1. The processing of personal data is governed by a separate document (GDPR).


11. COOKIES

11.1. The website uses cookies.

11.2. Cookies are stored only based on the user’s consent via the cookie bar.

11.3. Details are provided in a separate document.


12. FINAL PROVISIONS

12.1. Contractual relations are governed by Czech law.

12.2. If any provision is invalid, the remaining provisions remain valid.

12.3. The contract is archived in electronic form.


13. ENTREPRENEURS (B2B)

13.1. If the buyer provides their Company ID when placing an order, they are considered an entrepreneur/legal entity.

13.2. The following provisions do not apply to entrepreneurs:

withdrawal from the contract within 14 days

consumer protection under special regulations

13.3. Liability for defects is governed by the Civil Code:

the buyer is obliged to inspect the goods without undue delay

defects must be reported without undue delay

13.4. The seller is not liable for:

loss of profit

indirect damages

13.5. No warranty is provided to entrepreneurs unless stated otherwise.
